Limited Warranty Policy

This document contains the limited warranty offered by Piusi USA, Inc. ("Piusi USA") to the purchaser of products from Piusi USA ("Purchaser"). The Purchaser is tipically who purchases the product from Piusi for resale of the same to a subsequent reseller for final resale to the end user.

Piusi USA warrants to the Purchaser, under the terms and conditions hereof, that all products sold by Piusi USA ("Products") shall be (i) manufactured in accordance with the agreed upon specifications, (ii) merchantable and free from defects in material and workmanship, and (iii) conveyed with good title, free from any liens, security interests or other encumbrances. Products sold by Piusi USA are designed and manufactured in Italy. Certain Products are not certified by NRTL in North America. Piusi disclaims any and all liabilities arising from the absence of any NRTL certification. It is the customer's responsibility to verify the need for the Product to comply with any local rules and regulations.

With regard to parts manufactured by third parties (i.e. other than Piusi S.p.A.) warranty terms and conditions are those provided by the original manufacturer.

Warranty Terms:

Piusi USA limited warranty hereunder shall be of two (2) years after the date the product is sold to the end customer. Notwithstanding the above, in no event this limited warranty may exceed the maximum period of three (3) years from the date the product is sold by Piusi USA to the Purchaser. In order to determine the date of sale to the end customer, the original distributor's and reseller's invoices with Piusi USA serial number should be provided to Piusi USA Warranty Department. If these invoices or online warranty registration date are not available, the date the product invoices from Piusi USA warehouse in Ft. Lauderdale, Florida will be used as default. Different (i.e. longer) warranty periods may apply for specific Piusi products, as specified in the product packaging and/or advertising materials. In any case, the present Limited Warranty Policy shall apply.
All returns are subject to inspection upon arrival at Piusi USA. Piusi USA may approve or deny the claim and shall pay commercially reasonable efforts to communicate its decision within five (5) days, otherwise as soon as practicable. PIUSI USA, Inc. reserves the right to request the return of the failed product or parts for internal testing and analysis purposes. If a claim is accepted, Piusi USA will at reasonable discretion send a Replacement(*) Product(s) or part(s).

(*) The "Replacement Product(s)" may be a refurbished product when available and assumes the warranty identity and periods that applied to the item it substitutes.

Product inspection:

The Purchaser shall check all products and items immediately upon receiving each shipment. Shortages, damages, discrepancy in shipments, or noticeable defects of products or other items must be notified to Piusi USA in writing not later than five (5) days from receipt.

PIUSI reserves the right to request the return of the failed product or parts for internal testing and analysis purposes.

Proof of Purchase:

The proof of purchase is any documentation that proves beyond the reasonable shadow of doubt that a claimed product is to be within its warranty term. The primary source date will be the invoice date from the reseller to the end customer; and shall include the Piusi serial number.

In the event this document is not available with serial number, the alternative default date shall be the date of Invoice from Piusi USA to the Purchaser.

The serial number must be clearly documented on the Invoice or Receipt to utilize the date of said Invoice/Receipt. In cases where any product does not have a registered serial number, other identifying numbers such as batch number or lot number may be used in conjunction with the product code and the date printed on the product.

Credits:

Credits are not issued on general warrantied items and will be reviewed and authorized on a case-by-case basis, when applicable. Warrantied items are to be replaced, upgraded, or consigned at Piusi USA's sole and discretionary option.

Exclusions:

Piusi USA shall have no obligations under this warranty in the event that:

Replacement of products or parts shall have been required through normal wear and tear; or necessitated in whole or in part by force majeure, or by the fault or negligence of Purchaser or third parties.
The Products or parts have not been properly used, maintained or repaired in accordance with Piusi USA or manufacturer's then applicable operating and/or maintenance manuals and/or instructions, whether by Purchaser or third parties, or shall have been modified in any manner or dismantled without prior written consent of Piusi USA.
The defect is due to any other action attributable to Purchaser or third parties. Purchaser takes complete and entire responsibility for ascertaining whether the products meet the requirements of or are suitable for Purchaser's (or Purchaser's customer) intended use.

Duties of Piusi USA and Purchaser:

The sole obligation of Piusi USA in the event of breach of this limited warranty shall be, at Piusi USA's reasonable judgment, either (i) to provide at no charge to Purchaser replacement parts for all defective parts; or (ii) to credit the purchase price for the defective product, in whole or in part.

All replaced parts shall become Piusi USA property upon their replacement.

Any labor required for removal, repair, and installation or otherwise will be the responsibility of the Purchaser. Piusi USA will not reimburse or cover labor or travel under any circumstance.

Warranty claims hereunder must be filed promptly; must communicate the nature and details of the claim, the date the cause of the claim was first observed and the serial number of the Products or parts concerned; and must be received by Piusi USA no later than the date of expiration of the Warranty Term as above.

Piusi USA will request the return of any product for evaluation. Product(s) or parts must be returned to Piusi USA with an authorized written Return Material Authorization (RMA) from Piusi USA. Any unauthorized returns, i.e. one for which a RMA/has not been issued, will be returned to Purchaser at Purchaser's expense, and will not be accepted.

Processes:

All claims will be processed by written means only. This may be achieved by the following means:

Website. Warranty claims should be filed on the Piusi USA website; in the Contact Us sub-menu, Warranties: https://www.piusi.com/usa/support/warranty
1. Include images of the issue, an image of the name plate (sticker) and image of the serial number (silver sticker, black digits).
Email. Warranty claims can be made to any manager, Technical Support person or a group email at service.usa@piusi.com

Products must be received within 30 days from filing a claim. Claim will be closed after 60 days if products are not received.
Mark all packaging with the RMA; including the RMA number inside and outside to properly document Purchaser's return. Missing this step will result in a box returned to the sender.
Ship return goods to:
1. Piusi USA, Inc., Attn: Warranty Dept., 3901 Anglers Avenue, Ft. Lauderdale, Florida 33312.
Piusi USA will drop-ship approved warrantied items to End User(s) as desired. In return, the Purchaser shall be responsible for shipping defective item to Piusi USA at the address previously indicated.

Returns (new in box):

Purchaser is entitled to return the product to Piusi USA by convenience, subject to the following conditions. No fee will be applied if the product is returned within the first 30 days after purchase date.

Purchaser is subject to a 20% restocking fee on all items returned to Piusi USA after 30 days of purchase, and up to 50% restocking fee after six months of purchase. In addition, in order to be credited for the returned items (and received back into Piusi inventory) they must be in resalable condition and these three stipulations must be met:

The returned items must be in their original packaging box suitable for resale.
All manuals and accessories are present in new working order and in conditions suitable for resale.
All products are unused and were never installed in any application.

Piusi USA shall, at its sole and discretionary option, determine whether the above-mentioned stipulations are satisfied.

Proper protective packaging must be used so that items are not damaged in return transit. Piusi is not responsible for items damaged in return transit, and if they are not in resalable condition upon arrival no credit will be issued. In the case that a returned item is deemed un-salable the product will be customer will be permitted 60 days to advise on what to do with the product before it is scrapped.

No returns are accepted on Special Order items (this includes 50Hz items).

EXCEPT FOR THIS LIMITED WARRANTY, PIUSI USA MAKES NO WARRANTY OR REPRESENTATION WITH RESPECT TO ANY PROUCTS OR PARTS, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE OR USE.

The sole and exclusive remedies for breach of any and all warranties and the sole remedies for Piusi USA's liability of any kind (including liability for negligence) with respect to the Products or part and all other performance by Piusi USA, shall be limited to the remedies provided in the limited warranty provisions herein.

LIABILITY FOR DIRECT, INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL LOSSES OR DAMAGES OF ANY KIND (ALSO INCLUDING WITHOUT LIMITATION LOST PROFITS, LOSS OF BUSINESS, LOSS OF PRODUCTION, LOSS OF CUSTOMERS OR GOODWILL) IS HEREBY EXPRESSLY EXCLUDED. IN NO EVENT SHALL PIUSI USA'S LIABILITY OF ANY KIND EXCEED AN AMOUNT EQUAL TO THE PURCHASE PRICE OF THE PRODUCT PROVEN DEFECTIVE. LIABILITY FOR SPECIAL, INDIRECT OR CONSEQUENTIAL LOSSES OR DAMAGES IS HEREBY EXPRESSLY EXCLUDED. IN NO EVENT SHALL PIUSI USA'S LIABILITY OF ANY KIND EXCEED AN AMOUNT EQUAL TO THE PURCHASE PRICE OF THE PRODUCT PROVEN DEFECTIVE.
